A Penticton police officer who is facing charges under the Motor Vehicle Act in relation to the death of a five-year-old boy had his case appear briefly in court Oct. 12.
A single charge of driving a motor vehicle without due care and attention was sworn by Crown counsel on Sept. 9 against Const. Jimmy Ace Stewart after the Independent Investigations Office of B.C. (IIO) for charges in August.
The matter was adjourned on Oct. 12 in Penticton Provincial Court to Nov. 23.
Const. Stewart is alleged to have James Christian McIntosh, a Grade 1 student at Holy Cross School, on Sept. 15, 2015 at the intersection of Fairview Road and Highway 97 on the Channel Parkway.
Stewart is a veteran member of the RCMP with over 20 years of service and has been recognized for his work on several occasions.
