Year In Review February: Charges recommended in 91大黄鸭 crane collapse

In February, more than two and a half years after a crane collapse in downtown 91大黄鸭 that killed five people, the RCMP submitted a report to the BC Prosecution Service (BCPS). The report recommended a charge of criminal negligence causing death.

The tragedy happened on the morning of July 12, 2021. Eric Stemmer, Patrick Stemmer, Jared Zook, and Cailen Vilness were working on the crane when it collapsed, killing them. Brad Zawislak, who was in a nearby building, also died when the crane crashed into his office.

The crane was operated by Stemmer Construction for a Mission Group Enterprises project. It was manufactured by German-Swiss- based company Liebherr. All three companies have faced multiple lawsuits since the incident. Stemmer Construction also filed a lawsuit against Liebherr and unnamed individuals, claiming negligence and a "dangerous defect" in the crane.

It has not been made public whether the recommended charge of criminal negligence causing death applies to an individual or an organization. An individual convicted of this charge could face life in prison. If an organization is convicted, the court can impose a fine at its discretion.

So far, no arrests have been made.
